Terms of Service for BizFuel

Last Updated: August 24, 2026

By accessing our website or engaging BizFuel for digital marketing services, you agree to be bound by these Terms of Service.

1. Services and Scope of Work

BizFuel provides digital marketing services as outlined in your individual Statement of Work (SOW) or proposal. Any changes to the scope of services must be agreed upon in writing and may incur additional fees.

2. Payment Terms

  • Invoicing: Services are billed on a recurring monthly basis as outlined in your SOW. Payments are due upon receipt and will be processed automatically via the authorized credit card or ACH payment method on file on the invoice date.

  • Late Fees: Past-due balances are subject to a late fee of 1.5% per month. We reserve the right to suspend services for accounts significantly past due.

  • Refunds: Because our work involves dedicated time and strategic execution, all fees paid are non-refundable unless otherwise explicitly stated in writing.

3. Intellectual Property

  • Deliverables: Upon receipt of full payment, you own the final, delivered assets (such as ad copy, graphics, or final website design).

  • Agency Property: BizFuel retains all ownership of our proprietary strategies, internal workflows, pre-existing code, and third-party tools used to execute your campaigns.

  • Portfolio Rights: We reserve the right to feature completed projects and campaign results in our portfolio and marketing materials unless restricted by a mutually signed Non-Disclosure Agreement.

4. Client Responsibilities and Legal Compliance

  • Consumer Consent: You warrant that any customer lists or phone numbers provided to us for marketing purposes have been collected with explicit, legally compliant consumer consent (e.g., TCPA, CAN-SPAM).

  • Advertising Claims: You are responsible for ensuring that all product claims, testimonials, and offers provided to us comply with Federal Trade Commission (FTC) endorsement guidelines.

  • Web Accessibility: You are ultimately responsible for ensuring your website meets Americans with Disabilities Act (ADA) accessibility standards.

5. Privacy and Data Processing

For information regarding how we collect, use, and store data, please review our comprehensive Privacy Policy. By agreeing to these Terms, you also acknowledge and agree to the terms outlined in our Privacy Policy.

6. Disclaimers and Limitations

  • Warranties: Digital marketing relies heavily on third-party platforms. Because we do not control platforms like Google or Meta, BizFuel makes no guarantees regarding specific outcomes, search engine rankings, or guaranteed return on investment.

  • Liability: In no event shall BizFuel be liable for any indirect, incidental, or consequential damages. Our total liability for any claims shall be strictly limited to the total fees paid by you to us during the 3 months immediately preceding the event giving rise to the claim.

7. Term and Termination

Either party may terminate the service agreement with a 30-day written notice. You will be responsible for paying for all services rendered and expenses incurred up to the effective date of termination.
